This Privacy Policy explains how Clear Estate collects, uses, shares, stores, and protects your personal data when you use our website and property verification services. We act as the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Digital Personal Data Protection Rules, 2025, read with the Information Technology Act, 2000. By using the website or services, you acknowledge this Policy. Please read it together with our Terms & Conditions.

1. Who We Are

Clear Estate is the trade name of a sole proprietorship carried on by Mr. Solomon Suresh, with its principal place of business at No. J-29, Bharathidasan Street, Thirunagar, Ashok Nagar, Chennai – 600 083, Tamil Nadu, India. For personal data processed through our website and services, Clear Estate is the Data Fiduciary – the person that determines the purpose and means of processing your personal data.

  • Data Processor: a third party that processes personal data on our behalf and instructions
  • Personal Data: any data about an identifiable individual

3. Personal Data We Collect

We collect the following categories of personal data:

  • Verification inputs – the property documents you upload (such as sale deeds, encumbrance certificates, patta / chitta, legal-heirship and revenue records) and information about the property. These documents may contain your personal data and the personal data of third parties (see Clause 7).
  • Transaction data – orders placed, product selected, tax-invoice details, and GST information where you provide it.
  • Payment data – payments are processed by our payment provider; we receive limited confirmation data (such as transaction identifier and payment status). We do not collect or store your full card, UPI, or bank credentials (see Clause 10).
  • Technical and usage data – IP address, device and browser information, and log and cookie data when you use the website.
  • Communications – your queries, support requests, and correspondence with us.

4. How We Collect It

We collect personal data directly from you (at registration, order, and document upload), automatically through the website (cookies and log data), and from our payment provider (payment confirmation data).

5. Purposes of Processing

We process your personal data to:

  • provide the verification service, including assigning your Case to an independent advocate, carrying out the verification, and generating and delivering the report;
  • process your payment and issue a tax invoice;
  • dispatch the physical report to you by post, where your product includes physical dispatch;
  • communicate with you about your Case, queries, and support;
  • comply with legal, tax, regulatory, and record-keeping obligations; and
  • maintain the security and integrity of the platform, prevent fraud, and improve our services (using aggregated or de-identified data where possible).

6. Consent and Withdrawal

  • We process your personal data on the basis of your consent, and for certain legitimate uses and legal obligations as permitted under the DPDP Act. At or before the point of collection we provide an itemised notice of the personal data sought and the purpose.
  • Your consent is specific, informed, and unconditional. You may withdraw your consent at any time by writing to contact@clearestate.co. Withdrawal is as easy as giving consent. On withdrawal we stop further processing unless retention or processing is required by law or to complete a service you have already requested; withdrawing consent may mean we are unable to provide the verification service.

7. Third-Party Personal Data in Uploaded Documents

Property documents you upload may contain the personal data of persons other than you – for example prior owners, sellers, or legal heirs. By uploading such documents, you confirm that you are entitled to share that personal data for the purpose of the verification. We process it only for that purpose and in accordance with this Policy and applicable law.

8. How We Share Personal Data

We share personal data only as necessary, with:

  • the independent advocate engaged to carry out your verification;
  • our payment provider (Razorpay) to process your payment;
  • postal or courier partners to dispatch your physical report;
  • service providers acting as our Data Processors – such as hosting, cloud storage, e-signature, and communication providers – under agreements requiring confidentiality and appropriate safeguards; and
  • authorities, courts, or regulators where disclosure is required by law or to protect our legal rights.

We do not sell or rent your personal data, and we do not use it for third-party advertising.

9. Payment Information

Payments are processed by our payment provider on its own secure, PCI-DSS-compliant infrastructure. We do not receive or store your full card number, UPI credentials, or bank-account credentials. Your use of the payment provider is also governed by the provider’s privacy policy.

10. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes above and to meet legal, tax, regulatory, and professional record-keeping requirements. When no longer required, personal data is deleted or anonymised. Case and verification records may be retained for the period necessary to address any dispute or limitation period.

11. Data Security

We apply reasonable technical and organisational security safeguards, including access controls, encryption of data in transit, and restriction of access to the assigned advocate and authorised personnel. In the event of a personal-data breach, we will act in accordance with the DPDP Rules, 2025, including notifying the Data Protection Board of India and affected Data Principals as required.

12. Your Rights as a Data Principal

Subject to the DPDP Act, you have the right to:

  • access a summary of the personal data we process about you and the processing activities;
  • correction, completion, and updating of your personal data;
  • erasure of personal data that is no longer necessary for the purpose, or where you withdraw consent, subject to any legal retention requirement;
  • grievance redressal through the contact in Clause 16; and
  • nominate another individual to exercise your rights in the event of your death or incapacity.

13. Your Duties as a Data Principal

Under the DPDP Act, you agree to provide authentic information, not to impersonate another person, not to suppress material information where required, and not to register false or frivolous grievances or complaints.

14. Children’s Data

Our services are intended for persons 18 years of age or older. We do not knowingly process the personal data of children. Where processing of a child’s personal data is ever required, it will be done only with verifiable consent of a parent or lawful guardian, and we will not undertake tracking, behavioural monitoring, or targeted advertising directed at children.

15. Cookies and Cross-Border Transfer

  • We use cookies and similar technologies for website functionality, security, and analytics. You can control cookies through your browser settings; disabling some cookies may affect website functionality.
  • Your personal data is primarily processed in India. Any transfer or processing outside India will be carried out in accordance with the DPDP Act and only to jurisdictions not restricted by the Government of India.

We may update this Privacy Policy from time to time. The version published on the website applies from its effective date. Material changes will be notified through the website or by other reasonable means.
