These Terms & Conditions govern your access to and use of the Clear Estate website and the property document verification services offered on it. By accessing the website, placing an order, or making a payment, you agree to these Terms. If you do not agree, please do not use the website or the services. Please also read our Privacy Policy, Refund & Cancellation Policy, and Shipping & Delivery Policy, which form part of these Terms.

1. About Us and These Terms

  • The website and services are operated by Clear Estate, the trade name of a sole proprietorship carried on by Mr. Solomon Suresh, having its principal place of business at No. J-29, Bharathidasan Street, Thirunagar, Ashok Nagar, Chennai – 600 083, Tamil Nadu, India (“Clear Estate”).
  • Clear Estate is a technology-enabled facilitation and coordination platform for property document verification and reporting. Clear Estate does not itself practise law or provide legal advice; verification opinions are prepared by independent advocates engaged through the platform in their independent professional capacity.
  • These Terms apply to any person who accesses the website, registers, uploads documents, places an order, or makes a payment (the “Customer”, “you”).

2. Eligibility and Account

  • You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law.
  • You agree to provide accurate, current, and complete information at the time of registration and order, and to keep it updated. You are responsible for activity carried out through your account and for maintaining the confidentiality of your login and OTP credentials.

3. Services and Products

Clear Estate offers document-based property verification products for retail customers. The current products and prices are:

Verification is document-based only and is carried out on the documents and information you submit and on publicly available online records. It is a risk assessment and not a guarantee of title, ownership, or marketability, and does not cover court record searches, litigation history, or SARFAESI searches unless expressly stated. The scope and limitations of each product are described on the product page and in the report.

Prices are displayed in Indian Rupees (INR) and are exclusive of Goods and Services Tax (GST), which is charged additionally at the applicable rate. Prices may change from time to time; the price displayed at the time of your order applies to that order.

4. Orders, Fees, and Payment

  • Fees are payable in advance. Verification commences only after successful payment confirmation.
  • Payments are processed through Razorpay, a third-party payment aggregator, and other authorised payment service providers. By making a payment you also agree to the payment provider’s applicable terms. Your card, bank, UPI, or other payment credentials are collected and processed by the payment provider on its secure infrastructure; Clear Estate does not store your full card or banking credentials.
  • Clear Estate is not responsible for failures, delays, or errors caused by the payment provider, your bank, or your network. Where a payment is debited but the order is not confirmed, the amount is typically reversed by the payment provider within its standard timelines; contact us if it is not.
  • A valid tax invoice is issued for each order. You are responsible for providing correct GST details where you require an input-credit invoice.

5. Your Responsibilities and Warranties

  • You confirm that the documents and information you submit are true, complete, and genuine to the best of your knowledge, that no material document has been concealed, and that no document is forged, altered, or misleading.
  • Neither Clear Estate nor the engaged advocate is responsible for outcomes arising from forged documents, suppressed facts, incomplete document sets, or incorrect information supplied by you or third parties.

6. Verification Outcome and Report Delivery

  • Once verification is complete, your Case is assigned a status. Where the verification produces a clear (Green) result, the Clear/Green report is released to you as the final report and, where your product includes physical dispatch, a printed copy is sent to you by post.
  • Where a material issue is identified (a non-clear result), we will inform you that a material issue has been found and you will be offered a choice: (a) a refund of 50% of the product fee for the affected product, in accordance with our Refund & Cancellation Policy; or (b) an opportunity to submit an additional or corrective document so that the Case can be re-verified. You may use the re-verification route up to the number of rounds stated in the Refund & Cancellation Policy, after which the remaining option is the refund. We will not conceal from you the fact that a material issue was found.
  • The engaged advocate exercises independent professional judgment. Clear Estate does not, and will not, instruct any advocate to alter a genuine legal conclusion in order to produce a clear result. The re-verification route exists only to allow you to cure a genuine documentary deficiency, not to change a legitimate finding.
  • Reports are prepared for you alone, are specific to the Case and non-transferable, and may not be relied upon by any other person or used for any other property or transaction without our written permission.

7. Refund and Cancellation

Our refund and cancellation terms are set out in full in the Refund & Cancellation Policy, which forms part of these Terms. In summary: a full refund is available only before your Case is assigned to an advocate; a 50% refund of the product fee applies where a non-clear result is returned and you elect a refund; and no refund is payable once a Green report has been issued, for dissatisfaction with a genuine outcome, or after you have chosen the re-verification route for that round.

Refunds, where due, are processed to the original payment method through the payment provider within its standard timelines. GST on refunded amounts is adjusted in accordance with applicable tax rules.

8. Delivery and Dispatch

The digital report is delivered through the platform / to your registered email. Where physical dispatch is included, the printed Green report is sent by post to the address you provide. Delivery timelines are indicative and depend on document completeness, verification, and postal transit; they are not guaranteed. Full terms are in the Shipping & Delivery Policy.

9. Intellectual Property

The website, platform, software, templates, report formats, trademarks, and content are owned by or licensed to Clear Estate and are protected by law. You receive a limited, personal, non-transferable right to use your report for your own purposes. You may not copy, resell, redistribute, or create derivative works from our content without written permission.

10. Acceptable Use

You agree not to use the website or services for any unlawful purpose; not to submit forged or unlawfully obtained documents; not to misrepresent your identity or authority; not to attempt to gain unauthorised access to the platform; and not to use a report beyond the permitted scope or for third-party reliance.

11. Data Protection and Privacy

Clear Estate is the Data Fiduciary for personal data you provide, and processes it in accordance with the Digital Personal Data Protection Act, 2023 and the Rules made thereunder, as described in our Privacy Policy. By using the services you consent to such processing for the purpose of providing the verification service.

12. Disclaimers and Limitation of Liability

  • The services are provided on a document-based verification basis within the stated scope. To the maximum extent permitted by law, Clear Estate disclaims any warranty that a property is free of defects, litigation, or risk, and does not assume your transaction risk. The decision to transact rests solely with you.
  • To the maximum extent permitted by law, Clear Estate’s aggregate liability arising out of or in connection with a product, if any is established, shall not exceed the fee paid by you for that specific product. Clear Estate is not liable for indirect, incidental, or consequential losses.
  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your rights under consumer protection law.

13. Third-Party Links and Services

The website may reference third-party services (including the payment provider and postal/courier services). Clear Estate is not responsible for the content, policies, or performance of third parties, and your use of them is governed by their terms.

15. Governing Law and Jurisdiction

  • These Terms are governed by the laws of India. Subject to Clause 15.2, the courts at Chennai, Tamil Nadu have jurisdiction.
  • Nothing in these Terms restricts any right you may have to approach a Consumer Disputes Redressal Commission or other statutory forum available under applicable law.

16. Changes to These Terms

Clear Estate may update these Terms from time to time. The version in force at the time of your order governs that order. Continued use of the website after an update constitutes acceptance of the revised Terms.

17. Acceptance

By accessing the website, placing an order, or making a payment, you confirm that you have read, understood, and agreed to these Terms & Conditions and the policies referenced in them.
